US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.
The case originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her order, the court pointed out that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
